Michigan Trial Lawyer Understanding When Trial is the Right Option
As a Michigan trial lawyer, one of the questions I am very often asked is, "Isn't going to trial better for me than mediation, arbitration, or coming to a settlement agreement?" Here is the famous "it depends." Yes, sometimes a trial is the best way --the only way--to solve a particular problem. However, negotiation, settlement, mediation and arbitration can be better solutions in many cases. Why? It usually costs less, it can take less time, and result in a solution that causes a lot less heartache and stress on the parties involved. Particularly in divorce cases with children, negotiation --not litigation-- is usually better for everyone involved. One of the other aspects of this is that it is very important to hire a lawyer that understands trials and is comfortable with going to trial. Contrary to what most people think, many lawyers have never gone to trial, hate going to trial, and will avoid going to trial at all costs. There is a good reason for this-trials are the "last resort" in most cases, so very few cases actually go to trial. For this reason, many lawyers do not have trial experience. However, if your case is one of the ones that merits a trial--or, from a strategic point of view, if the opposite side understands that your lawyer is a trial lawyer and is not uncomfortable with the trial process--you are, in most cases, in a much better bargaining position.
