As a Michigan child custody lawyer, I often hear from my clients about why their child should live with them. It is true, there are many reasons why children should live with one parent over another, or why legal custody should be awarded to only one parent. However, one of the frequent issues I face is the assumption by clients that custody will be automatically granted to the mother, or to only one parent. |
As I often tell my clients, what many people do not realize is that the days where the mother is considered to be the automatic choice for child custody are now gone. Therefore, child custody cases are more complex than most people believe.
In Michigan, the Child Custody Act assumes that it is in the best interest, whenever possible, of children to have a relationship with both parents. For this reason, joint legal and physical custody is always considered by the court when there is a Michigan child custody dispute, even if eventually it is not the final decision of the court to award joint custody. Understanding the different types of child custody is important for anyone going through a divorce with children or that has a child with another person that results in a dispute.
