Marriage Visa, Understanding the Process for Obtaining a K3 Visa in the United States

This is a type of visa based on a spousal relationship, and is one of the most commonly used instruments for obtaining lawful immigration status to the United States. Unlike other types of visas, where the foreign person applies, in the case of a marriage visa it is the US citizen that makes the application (also known as a petition) for their foreign-born spouse as an immediate relative.

To obtain a K3 visa, the US citizen or permanent resident spouse must begin the process (or through their immigration attorney) by submitting, by mail, a visa petition to the USCIS. The visa petition form is called an I-130.

The form's purpose is to prove to the immigration authorities that you are legally married. After the petition is approved, the immigrant spouse will then submit a green card application and attend an interview (usually with your spouse).
