Attorney Fees Michigan: Probably the most frequently asked question from clients and potential clients is, "What are your firm's fees?" There are several ways an attorney can bill for fees in Michigan: flat fees, contingent fees, hourly fees, or a combination of those. Many clients prefer the contingent fee method, because it means that the lawyer does not get paid unless there is a successful resolution to the case. However, in Michigan, it is not legal for an attorney to charge on a contingent fee basis for family law/divorce cases or for criminal cases. Contingent fees are most often seen in personal injury cases. Some clients like the flat fee arrangement, because it means that there is a fixed fee that is known in advance. However, the flat fee arrangement has its pitfalls. If the lawyer charges more than the case would be worth on an hourly basis, the client gets shortchanged. If the the lawyer charges less than the case would be worth on an hourly basis, the lawyer gets shortchanged--but possibly, the client may as well, if the lawyer's time becomes too stretched. At the Wipp Law Firm, most cases are taken on an hourly basis with a retainer. (A retainer is money paid up front as funds for your legal case.) Except in very rare circumstances, we do not have non-refundable retainers. All time is billed against the retainer, and if there are funds left over, they are returned to the client.
