K1 Fiancee Visa
A K1 fiancee visa, or “fiancé visa,” is for non-citizens (aliens) who are outside the United States and are engaged to be married to a US citizen.
In most cases, but not all, you are required to have met your fiancée within the last two years in person.
Unlike many other types of visas, with a K1 visa the US citizen, also called the petitioner, is the one that files for the visa. The non-citizen alien is called the beneficiary.
Please note that you must plan on being married within 90 days of the beneficiary entering the United States. For many couples, this makes planning for the actual wedding difficult, as the process of getting the visa takes some time, and there is no definite timeframe as to when you will actually receive the visa.
After approval of the initial documents by the USCIS, the embassy or consulate where the beneficiary resides must process the file, and additional supporting documents, as well.
After the marriage, the alien beneficiary may file to adjust their status and gain conditional residence.
Failure to follow the correct procedures or to properly fill out the documentation necessary to obtain the K1 visa may result in denial of the visa. Depending on the circumstances, it may be difficult, time consuming and expensive to remedy this problem. Make sure it gets done right the first (and then, hopefully only) time!
